General terms and conditions

Article 1: Definitions

At BigGym, we believe it is very important to make clear and transparent agreements with our members. This way, we keep it enjoyable for everyone. By becoming a member of BigGym, you declare that you have read and accepted the terms and conditions as well as the house rules. You can find the terms and conditions and the house rules at www.biggym.com.

1.1 Promotion: An offer provided by BigGym to new members, in which contract duration and price may differ from the standard offers.

1.2 Reversal fees: A fee charged for late or failed payment.

1.3 Absence: When you are unable to come and work out, for any reason.

1.4 Contribution/membership fees: The membership fee you pay every 4 weeks.

1.5 Member: You can become a member if you are an individual aged 14 years or older.

1.6 Financially responsible person: The person financially responsible for the membership fees.

1.7 Family members: Members who are related and live together at the same address.

1.8 Upgrade: A change to a membership where the value and contract duration of the membership are increased.

1.9 Activation fee: The fee charged upon registration for activation.

1.10 Membership: The agreement entered into between you and BigGym upon registration. These terms and conditions are also part of your membership.

1.11 Lockers: Lockers where you can store your belongings.

1.12 Notice period: One full collection period that BigGym will collect from you once you have cancelled your membership.

1.13 Primary payer: The person responsible for payment in a Together membership. The contribution will be debited from the primary payer’s bank account.

1.14 Collection period: The four (4) week period during which membership fees are collected by BigGym.

1.15 Personal guidance: Assistance from the gym staff such as introductory advice, explanations about the equipment, and fitness tips. This is not a personal training session.

Article 2: Registration

2.1 You can become a member of BigGym by registering through the registration form on the BigGym website or via the BigGym app.

2.2 Registration through a Sports Fund can be done at the reception of one of the BigGym locations.

2.3 After registering, you can start working out at BigGym right away!

Article 3: Access and personal data

3.1 Once you have registered, your personal data will be recorded in our administration.

3.2 By registering with BigGym and making the first payment, you authorize BigGym to collect the membership fees via direct debit.

3.3 Your access to BigGym is verified by scanning the QR code at the entrance.

3.4 With a Together membership, you may always work out at the same time!

3.5 Your personal data is strictly confidential and will not be used for purposes other than granting access to BigGym.

3.6 Your personal data will be shared with third parties if necessary.

3.7 BigGym is authorized to use your personal data for communication purposes.

3.8 When you check in to work out, a photo of you will be displayed on the cashier’s screen for verification purposes. BigGym cannot prevent this photo—intended for the gym staff—from being visible to other members.

Article 4: Membership, term, and payment

4.1 Your membership officially starts from the moment of registration for either an indefinite or fixed term (depending on your chosen membership), with a minimum of two full collection periods.

4.2 If you have chosen an Unlimited, Together, or Daytime membership, it will automatically be renewed for an indefinite period after your contract ends. The membership fees will be adjusted to the current rates. After this, your membership can be canceled every 4 weeks, with a notice period of one full collection period starting from the date of cancellation.

4.3 If you have chosen a Flex or Junior membership, the notice period is one full collection period starting from the date of cancellation.

4.4 If you are under 18 years old, you need permission from a parent/guardian to sign up for a BigGym membership. This can be done by completing the consent form in the online registration form on the website or in the location itself.

4.5 If you have a Together membership, both members must be able to prove that they live at the same address. This must be done by providing an official letter from a government institution.

4.6 Membership payments are collected every 4 weeks. After the initial membership period, we reserve the right to change the collection period to a 4-week schedule.

4.7 If you have a Together membership and we are unable to collect the fees from the primary payer, the fees will be collected from one of the bank accounts of the other members linked to the primary payer of the Together membership.

4.8 You must ensure that we can collect the membership fees without issues. If this is not possible, we will be forced to charge €10 in reversal fees per failed transaction.

4.9 If you have not paid your membership fees on time, you will automatically be in default. We will determine on a case-by-case basis when to proceed with termination.

4.10 In case of payment arrears for a one- or two-year membership, 100% of the total remaining amount becomes immediately due. Any extrajudicial collection costs incurred thereafter will be at your expense and amount to 15% of the outstanding sum, with a minimum of €40.

4.11 If your membership fees have not been paid on time, access to BigGym will not be granted.

4.12 A Family Pass cannot be renewed or upgraded. The terms for a Family Pass apply only to current members with a Family Pass. Once your Family Pass agreement ends, it will be converted into a Together membership. The articles related to a Together membership will then apply from the date of conversion.

4.13 If you are registered under a Family Pass, it will be converted into your own personal membership once you are over 23 years old.

4.14 If you have a Junior membership and turn 14 years old, it will be converted into an Unlimited membership.

Article 5: Rates, membership payment continuation, promotions, and terms and conditions

5.1 We reserve the right to amend or supplement our terms and conditions and house rules.

5.2 We reserve the right to index and/or change our prices and membership rates, as well as any add-ons.

5.3 Price adjustments due to government measures may be implemented immediately, regardless of the amount, and do not give the right to terminate the agreement.

5.4 We may increase our rates once per year. If we do so, this does not give the right to terminate the agreement unless the price increase occurs within three months after the start of the membership.

5.5 For promotions and/or special offers, you can request the terms at BigGym locations or via our customer service.

5.6 No rights can be derived from promotions and/or special offers, either before or after participation.

5.7 Promotional periods are always applied before the start of the membership unless stated otherwise. Promotional periods are excluded from the contract duration.

5.8 Promotions taking place at a new location are only valid if you register at that specific new location.

5.9 Under no circumstances can you claim a refund of membership fees or any other amounts.

5.10 If you are absent for any reason, this does not release you from the obligation to pay the membership fees owed and does not grant the right to any reduction thereof.

Article 6: Conversion / termination

6.1 A conversion is only possible when your one- or two-year membership ends, unless you want to upgrade your membership.

6.2 In the case of an upgrade and/or conversion of your membership, the start date will take effect immediately. From that moment, your new membership begins.

6.3 If you wish to cancel your membership, this can only be done via the BigGym app.

6.4 Early termination or freezing of an Unlimited or Daytime membership is only possible if:

– You change your residence to a location more than 30 kilometers away (based on the shortest route) from any BigGym location. This will only be accepted if you provide an official “municipal registration” document of your new address as proof. Once this document is approved, you must buy out your membership. For a one- or two-year membership, your owed contribution will be recalculated to a Flex membership rate.

– You are unable to use your membership due to an injury or illness. The membership can then be paused for a maximum of 3 full collection periods, during which your membership will be on hold. If you pause your membership for 3 full collection periods, it will also be extended by the same length. This can only be accepted with an official doctor’s note as proof.

– The government decides that a mandatory closure period is in effect. In this case, we will offer the option to temporarily freeze your membership for the duration of the measure. Once the mandatory closure period ends, your membership will automatically resume. Your contract period will be extended accordingly.

6.5 If you are the primary payer of your Together membership and you cancel your own membership, it will automatically be transferred to one of the other linked members. The Together membership must always be canceled jointly if all linked members wish to stop.

6.6 If you signed up for a membership via the online registration form on the BigGym website, you have a 14-day withdrawal period. This withdrawal period starts on the day you signed up for your membership.

6.7 If you decide to withdraw your membership, this can be done by completing the withdrawal form on the website.

6.8 If you withdraw your membership within the 14-day period without using it, the withdrawal is free of charge. If you have used the membership during this period, BigGym will charge the cost of a day pass (€10) per visit made. Administration fees already paid will not be refunded under any circumstances.

6.9 Cancellations sent by email, fax, online chat, social media, phone, or in person will not be processed.

6.10 If you fail to comply with the terms of the agreement, our house rules, or display inappropriate behavior as indicated by the gym staff or gym manager, we may deny you access to BigGym and terminate your membership immediately.
Inappropriate behavior includes, but is not limited to:

  • Expressing negativity within the club that harms the atmosphere.
  • Promoting competing gyms, especially within the BigGym location or community.
  • Having disputes or serious conflicts with staff, particularly if this occurs repeatedly or is threatening in nature.

The assessment of such behavior is at the sole discretion of BigGym. If you re-register at BigGym, this may be grounds for immediate termination of your new membership again.

6.11 Any remaining credits cannot be used after the termination of the membership.

Article 7: Risk and liability

7.1 Use of BigGym facilities is entirely at your own risk.

7.2 If you are the primary payer of a Together membership, you are at all times responsible for the membership. In the case of overdue payments, all linked members will be held liable. See Article 4.

7.3 We are not liable for material or immaterial damage resulting from accidents or injuries sustained in our gyms.

7.4 We advise you not to bring valuables. BigGym does offer free lockers to help limit damage, loss, or theft of belongings as much as possible. The cost of a BigGym combination lock is a one-time fee of €10. The use of your own lock is not permitted.

7.5 We are authorized to cut open any locks left on after closing so that the lockers can be used again the next day.

7.6 Fitness activities may carry risks. When using our facilities, it is your responsibility to know your own limits. The use of the facilities is at your own risk. If you are in doubt about your physical condition, we recommend seeking professional advice from a doctor or specialist to determine the safest and most effective training method for you.

7.7 Our gym staff does not provide personal training sessions in the gym. However, we do offer free guidance to help you achieve your goals. You can hire your own personal trainer or make use of the tips and advice we share on social media, the BigGym app, or through other in-gym resources. We are not responsible for how you apply these tips and advice or the choices you make.

7.8 We are not liable for damage to and/or theft of your vehicle or other means of transportation as a result of parking on BigGym premises.

7.9 You are liable for any damage caused to our property if such damage is due to your negligence and/or fault.

7.10 It is not permitted to make or publish audio or visual recordings of staff or members without permission.

Article 8: Complaints procedure

8.1 If you have a complaint, we are sorry to hear that, but we are of course happy to listen. You can always contact our customer service via the BigGym website.

8.2 We kindly ask you to include your name, address, and contact details along with a description of the complaint. We will then ensure the complaint is handled properly.

Article 9: Final provisions

9.1 By registering, you declare that you are aware of, accept, and will adhere to the terms and conditions and house rules.

9.2 The terms and conditions and house rules of BigGym can be found on the website and can also be requested at the BigGym front desk.
