BigGym B.V. is responsible for the processing of personal data as described in this privacy statement. If you have a BigGym membership, wish to sign up for a BigGym membership, or visit our website out of interest, we will need certain information and data from you. The processing of your data is subject to laws and regulations, including the General Data Protection Regulation (GDPR).

Below, we have outlined which data we process about you, why we do so, and how we handle your personal data. In addition, we explain how you can influence the processing of your personal data by BigGym.

As we are a dynamic company in a rapidly evolving environment, it is important for us to update our privacy policy from time to time. The most up-to-date version can always be found on our website. We therefore advise you to visit this page regularly.

Which of your data do we process?

BigGym processes personal data. According to the GDPR, personal data is “any information relating to an identified or identifiable natural person (‘the data subject’).” This means all data that can be traced back to you as a person.

Data from our (potential) members
When entering into a BigGym membership, we process at least your name, address, place of residence, date of birth, bank account number, phone number, and email address.

Even if you already have a BigGym membership, we continue to process such personal data—for example, each time you visit our gym or when you contact us by phone or email.

Data from our website visitors
We also process (personal) data from every visitor to our website. This may include personal data you enter on the website itself, such as your email address, name, home or work address, or phone number.

Browsing and click behavior
We also collect information about your visit to our website. This primarily involves data that your browser automatically sends to every website you visit, such as your IP address. We may also collect information about which pages of our website you view, which links you click on, how often you visit our website, and other actions you take—also referred to as your browsing and click behavior.

Cookies
A cookie is a small amount of data sent by a server to your browser, intended to be stored and then sent back to the server on a subsequent visit. This allows the server to easily recognize your browser again. Our website uses (temporary) cookies, sometimes from third parties. BigGym does not have access to these third-party cookies.

Social Media
The data you provide on social media, or that we collect based on your responses to social media content, is processed by BigGym. This may include personal data you enter on the contact page of the relevant platform itself, such as your email address, name, or phone number.

How do we handle children’s data?

Our services are not aimed at children. This means that the use of biggym.nl by customers under the age of 18 is only permitted with the explicit consent of a parent or guardian.

Why do we process your data?

Service provision
Without processing your personal data, BigGym cannot provide its services to you. For example, we would not be able to create a membership account for you, which means you would not be able to access a BigGym location. Or, if you asked us a question, we would not be able to answer it. When granting access to BigGym, an image of the respective member is displayed during the scanning of the pass. BigGym cannot exclude the possibility that this image—intended for the front desk staff—may be visible to bystanders during the scanning process.

BigGym works with partners, for example to provide our services or to collect outstanding invoices. This means we may share your personal data with those partners. We require our partners to at least comply with the Dutch Data Protection Act (Wbp). They must handle your personal data with care and are prohibited from using your data for any other purpose than the one for which it was provided to them.

Legal obligation
BigGym may be required by law or regulation to process and/or share your personal data with third parties. For example, when a competent authority—such as the police—requests this in the context of a criminal investigation.

Marketing and sales activities
BigGym may process your personal data for marketing and sales activities (even after the termination of your membership) for its own services or those of companies affiliated with BigGym. Your data may be used to make offers to you, whether in writing, by phone, or electronically (including by email).

Only in exceptional cases, such as when our company is (partially) sold, acquired, or legally split, and our business activities are continued by a third party, will we be entitled to sell the personal data. A (future) member explicitly gives consent for this.

(Market) research and analysis
We may use your personal data for conducting research and performing analyses, with the goal of improving both our website and our services.

Cookies
BigGym uses functional and analytical cookies. A cookie is a small text file that is stored in your computer, tablet, or smartphone browser during your first visit to this website. BigGym uses cookies with purely technical functionality. These ensure that the website works properly and that, for example, your preference settings are remembered. These cookies are also used to help the website function correctly and to optimize it. In addition, we place cookies that track your browsing behavior so we can offer tailored content and advertisements. During your first visit to our website, we informed you about these cookies and asked for your consent to place them.

How do we handle your data?

Security
BigGym ensures appropriate organizational, technical, and physical security of its members’ data. Your data is therefore not accessible to all BigGym employees. In addition, we only use your data as outlined in our privacy policy. If you believe your data is not properly secured or there are signs of misuse, please contact our customer service.

Retention period
We store your data only as long as necessary to achieve the purposes for which we process it, and never longer than legally permitted. The exact retention period depends on the type of personal data. If you have a BigGym membership, we keep your data for at least the duration of your membership.

Depending on your browser settings, temporary cookies are deleted shortly after your visit.

How can you influence the processing of your personal data?

Access
All members have the right to access their personal data. Of course, you can request in your gym which data they have registered about you.

If that is not sufficient, you can submit a request for access by sending a letter to BigGym, Postbus 102, 1960 AC in Heemskerk, stating “access request” and including your name, address, landline and/or mobile phone number, and a copy of a valid ID.

Correction
All members also have the right to have their personal data corrected if it is inaccurate. You can also do this at your location. If, for any reason, that is not possible, you can send a letter to the above-mentioned address, stating “correction request” and including your name, address, landline and/or mobile phone number, and a copy of a valid ID. We will provide a written response within 4 weeks.

Objection
If your personal data is used for purposes other than those necessary for fulfilling an agreement or complying with a legal obligation, you can object to that use. You can particularly object to the use of your data for commercial purposes, such as direct marketing activities, as well as the provision of your data to third parties for the same direct marketing purposes. This is possible even if you previously gave consent for such use.

If you object to BigGym using your personal data for the commercial purposes listed below, please send:

  • An email including your name, address, landline and/or mobile phone number, and a copy of a valid ID to our customer service. We will respond within 4 weeks of receiving your online objection.

  • Or a letter including your name, address, landline and/or mobile phone number, and a copy of a valid ID to our postal address. We will respond within 4 weeks of receiving your written objection.

Clearly state in your letter which type of use of your personal data you object to:
– BigGym direct mailing by post; and/or
– Commercial email, including the BigGym newsletter; and/or
– Telemarketing by BigGym.

We will do our best to process your objection as quickly as possible administratively. It may take some time before this is completed, so you may still be contacted by us in the meantime. You can also much more easily stop commercial contact via email by following the instructions provided in the email message!

No cookies
Your web browser – like most web browsers – will automatically accept cookies. You can adjust your browser settings yourself. Depending on your browser and permissions, you can choose to automatically reject all cookies. If you choose to do so, some functions of the websites you visit, including the BigGym website, may no longer work or be available to you.

Third-party cookies that are affiliated with the Interactive Advertising Bureau Netherlands (IAB) will, as of September 2011, not be automatically placed on your hard drive, regardless of your settings. Each advertisement from these third parties will display an information icon. By clicking on this icon, you will be directed to the “Your Online Choices” website. BigGym takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized alteration. If you believe your data is not properly secured or you suspect misuse, please contact our customer service.
